The main idea of the article is the research of the appearance and the development of the legal positivism it's influence on the development of the scientific thought. There is analysis of the criticism of legal positivism by the famous scientist in this article. The Aim of the research is not just to check the negative sides of the legal positivism, but to notise the positive moments, which were useful for creating legal ideology.
