Анотація:
Статья посвящена вопросам соотношения международной и внутригосударственной правовых систем. Рассматриваются новые грани соотношения и взаимодействия указанных правовых систем, раскрывается структура правовой системы государства, анализируется диаметральная противоположность подходов специалистов в области международного и конституционного права к соотношению международных норм и норм Конституции России, обосновывается тезис о приоритете международных договоров над нормативно-правовыми актами государства, включая Конституцию РФ.
The article deals with the problems concerning the correlation between international and national legal systems and continues the discussion that has been held in the journal "Pravovedenie" over the recent years. This article discusses new aspects of relationship and interaction between these legal systems, reveals the structure of state legal system; diametrically opposed approaches of specialists in international and constitutional law to the correlation of international rules and norms of the Constitution of Russia are examined; the author substantiates the thesis of the priority of international treaties over the normative legal acts of the State including the RF Constitution.
