Висвітлено основні проблеми, пов’язані із законодавчою регламентацією прова-

дження негласних слідчих (розшукових) дій. На підставі чинного Кримінального процесуального кодексу та Закону України "Про оперативно-розшукову діяльність" розглянуто співвідношення негласних слідчих (розшукових) дій та оперативно-розшукової діяльності.

Освещены основные проблемы, связанные с законодательной регламентацией производства негласных следственных (розыскных) действий. На основании действующего Уголовного процессуального кодекса и Закона Украины "Об оперативно-розыскной деятельности" рассмотрено соотношение негласных следственных (розыскных) действий и оперативно-розыскной деятельности.

The article is devoted to the basic problems related to the legal regulationof covert investigative proceedings ( investigation ) action. On the basis of the Criminal Procedure Code and the Law of Ukraine "On Operational Activities" Consider the undercover investigator ( detective ) activities and operational activities. Thus, according to the law of Ukraine "On Operational Activities" under the Operational Activities shall mean a system of overt and covert search, intelligence and counterintelligence activities carried out with the use of operational and operational- technical means. In turn, the current Code of Ukraine stipulates that undercover investigators (ODA) is a kind of investigative action (investigation) of action, information and methods of fact which can not be disclosed except as required by law. According to Part 1, Art. 246 Code of Ukraine, undercover investigators (ODA) actions are a form of investigative (detective) actions, information about methods of fact and are not subject to disclosure, except as provided by Code of Ukraine. As you can see, the legislators did not fully highlighted the essence of the concept and its relevance to criminal proceedings. Special attention is given issue features go and fix the results of covert investigative (detective) action. Somewhat controversial, in our opinion, is the provision of Art. 253 Code of Ukraine, which establishes a duty to inform individuals whose constitutional rights have been temporarily restricted in connection with the undercover investigator (detective) actions.
