У статті розглядаються положення Закону України "Про запобігання коруп-ції", якими встановлено обмеження щодо одержання подарунків, досліджу-ються особливості притягнення до відповідальності за таке порушення та аналізуються превентивні заходи щодо запобігання вчиненню адміністративного правопорушення, пов"язаного з корупцією в цій сфері.
В статье рассматриваются положения Закона Украины "О предотвращении коррупции", которыми установлены ограничения относительно получения подарков, исследуются особенности привлечения к ответственности за такое правонарушение и анализируются превентивные меры по предотвращению совершения административного правонарушения, связанного с коррупцией в этой сфере.
In the article we discuss the provisions of the Law of Ukraine "On Prevention of Corruption" which sets limits on obtaining of gifts, features of prosecution for a violation and analyse measures to prevent the commission of administrative offenses related to corruption.
The most common causes of corruption in Ukraine are abuse of power by state employees who use their posts for their own benefits, and absence of proper control of state officials by law enforcement body.
Based on the provisions of anti-corruption legislation administrative offence re-lated to corruption is an act committed by individual authorized to carry out the functions of the state and local government that contravenes the provisions of the Basic Law but does not contain official misconduct or power connected to that for the purpose of:
- obtaining of illegal gain or its reception
- reception of promise/offer of such gain for one`s or someone else`s own
- promise/offer or provision of illegal gain to an individual or another person or legal entity on individual`s request with the purpose to incline that person to illegal use of authorities or power connected to that.
One of the urgent questions that comes up while interaction of the new anti-corruption legislation with the provisions of law in force is the issue of procedural peculiarities on proceeding in the cases on violation of statutory limitations on receiving gifts.
Gift or donation is the matter of administrative corruption offences that are amenable under provisions of Article 1725 of the Сode of Administrative Offences. Content ascertainment of mentioned terms is extremely important to establish the characters of actuaries. We can define two kinds of constituent elements of such offence based on the content of Article 23 of the Basic Law:
Violation of the prohibition of receiving gifts (donations) in view of these individuals` activity connected to charring out the functions of the state and local government, including when person who is gifting is subordinated.
Violation of provision that sets limitation to the cost of the gift.
We determine some gaps and inaccuracies of legal regulation in the new anti-corruption system while analysing particular provisions, legal regulation of gift receiving limitations included. Although, in our opinion, these inaccuracies can be adjusted by minor modifications of regulatory legal acts or with the help of relevant authorities' interpretations.
