У статті розглядаються проблеми правового регулювання розміщення базових станцій систем стільникового зв"язку в контексті реалізації конституційного права на безпечне для життя і здоров"я навколишнє природне середовище. Досліджується наявний стан правової регламентації захисту населення від негативного впливу електромагнітного випромінювання базових станції стільникового зв"язку за законодавством України та ЄС. Сформульовано пропозиції з удосконалення вітчизняного законодавства в цій частині.
В статьеподнимаются проблемы правовой регламентации размещения ба-зових станций систем мобильной связи с точки зрения реализации и защиты права каждого человека на безопасную окружающую среду. Рассматривается национальное законодательство Украины, а также опыт европейского сообщества на предмет его эффективности в сфере защиты населения от негативного воздействия электромагнитного излучения базових станций систем мобильной связи. В результате проведенного анализа формулируются предложения по предупреждению негативного влияния на человека электромагнитного излучения, которые целесообразно закрепить на законо-дательном уровне.
The public is exposed to electromagnetic fields (EMF) generated by an increasing variety of electrical and electronic devices and installations. In recent years, there has been a special interest of sociaty due to the increasing amount of the mobile phone base stations placed close to dwellings. It is the States' responsibility to protect the population from potential health risks by providing an effective legislation. In light of these facts the aim of this article is to examine the national regulation concerning the existing legislative measures seeking to limit the exposure of public to electromagnetic radiation from the mobile phone base stations and to seek the ways to improve them.
As a result of the conducted research the author has made several proposals to the current legislation seeking to limit the public exposure to electromagnetic fields.
In the author opinion among such measures should be: 1) recommendation to place the mobile phone base stations away from the public or living zones; 2) applying the ALARA principle, under which exposure radiation must be as low as possible; 3) providing industrial, state, local and public control for the level of electromagnetic emission by the mobile phone base stations; 4) applying such measures as changing the regime or full stopping the activity of the mobile phone base station in case of exceeding the binding limits of reference levels for electromagnetic fields; 5) establishment the compensation for damage from the exposure to electromagnetic fields from the mobile phone base stations; 6) in order to increase understanding of risks and protection against exposure to electromagnetic fields the state should provide, in an appropriate format, information to the public on the health impact of electromagnetic fields and the measures taken to address them; 7) applying the mechanism for taking into account the public opinion on the question of the mobile phone base station location.
