Today, Section VII-1 of Civil Procedure Code of Ukraine distinguishes proceedings in cases of appeals of arbitration decisions and proceedings in cases of issuance of a writ of execution to enforce the arbitration courts decisions, which enables the parties to fully protect their rights and interests, if they are violated. This section is a direct correlation
between the civil proceedings and arbitration. Proceedings in cases of appeals of arbitration decisions and proceedings in cases of issuance of a writ of execution to enforce the arbitration courts decisions are independent institutes of civil proceedings and act on par with the affairs of action or special proceedings, since shares many features with them. In the article author looks into the nature of proceedings in cases of appeals of arbitration decisions of Ukraine, analyzes the regulatory framework that governs the relationship of appeal against arbitration decisions, identifies the major theoretical and practical problems arising in the appeal. Also, the article deals with the issue of the beginnings of arbitration, its historical development and formation in Ukraine. Special attention is paid to the definition of the institute of proceedings in cases of appeals of arbitration decisions, its place in civil proceedings. Emphasized the discussion on definitions of civil procedure and civil proceedings, according to researchers nvestigated this issue and given the analysis and separation of these concepts. Also concluded that the proceedings in cases of appeals of arbitration decisions is the arbitration stage.
The conclusion is given about the critical need for further research and legislative developments in the field of state
control over the activities of arbitration, because existing laws today, explanations and generalizations that are issued
by the Supreme Court and the High Court Specialized in civil and criminal cases, unfortunately, do not have
sufficient basis for proper, legitimate and effective functioning of arbitration and, consequently, greatly complicates
the activity of state courts, which have to correct these arbitration deficiencies.
