У статті здійснено аналіз законодавства України й наукових досліджень щодо реорганізації та ліквідації центральних органів виконавчої влади. Визначено проблемні питання, які виникають у процесі такої реорганізації й ліквідації.
В статье осуществлен анализ законодательства Украины и научных исследований относительно реорганизации и ликвидации центральных органов исполнительной власти. Указано на проблемы, которые возникают в процессе такой реорганизации и ликвидации.
The analysis of legislation of Ukraine and scientific researches of reorganization and liquidation of central executive bodies is carried out in the article. It is indicated on problems that arise up in the process of such reorganization and liquidation. Clear system of executive bodies is not prescribed in Constitution of Ukraine. Although this feature is
inherent to the constitutions of other countries. Obviously, it is related to the necessity of providing flexibility at creation, reorganization or liquidation of executive bodies. In fact such changes will require changes in Constitution, that is not always simply. One of the main negative factors in the transformation of Ukraine into a modern, stable rule of law country is lagging behind the reform process of the executive branch of the changes in the social life of the state, new economic and political relations. It is a fact that the system of central executive authorities is in the process of the reformation to the present day. Dynamic social relations does not allow the current executive branch fully realize its function without effective governance reforms completion. First of all it concerns outline the tasks and responsibilities of the various elements of management and shady actions of government. Often there is an underestimation of new planning tools. A major problem is the inefficient use of funds. Changes in the structure of the central authorities were often inconsistent, to some extent chaotic, not based on doctrinal and conceptual developments. The lack of complexity in the regulation of the structure of central authorities is obvious. This would contribute to speed of regulation but in practice this often leads to consolidation hasty and imperfect legislative changes in the system of organs. This problem will only lead to the bureaucracy rather than to fighting it. Also, there is a significant decrease in the level of competence of employees, as good professionals do not want to work in such ambiguous terms. In such circumstances, it is not expected to improve the quality and performance of the state apparatus, especially on the basis of the principle of legality.
