Визначено поняття права власності підприємства. Проаналізовано підходи до розуміння захисту права власності, проведено його розмежування з правом на захист. Розмежовано також поняття захисту та охорони. Досліджено специфіку поняття цивільно-правового захисту права власності підприємства.

Определено понятие права собственности предприятия. Проанализированы подходы к пониманию защиты права собственности, проведено разграничение с правом на защиту. Разграничены также понятия защиты и охраны. Исследована специфика понятия гражданско-правовой защиты права собственности предприятия.

Ownership of the enterprise is defined as the right of the company (as a subject of property right) on the property, which the enterprise realizes under the law through authorized persons by possession, use, disposal and management. The approaches to the understanding of ownership protection have been analyzed; the differentiation from the right on protection has been realized. The concepts of security and protection have also been differentiated.

The specific of the concept of civil and legal protection of enterprise’s ownership has been studied. The author has outlined the main features of civil and legal protection, namely: the system of legal means aimed at ensuring and realizing appropriate civil rights; the system of legal norms ai med at preventing violations and elimination of their consequences; work of the court or other jurisdiction agencies preventing and restoring violated right. Under the civil and legal protection of the enterprise’s ownership the author understands, first of all, the use of such legal means (ways) that ensure the elimination of obstacles in realizing the ownership and restoration of property status of the enterprise because of property benefits of the offender or other obligated person, including by the way of demanding (return) property belonging to the owner from illegal possession.
