Розглядаються механізм і зміст процедури банкрутства суб"єктів підприємницької діяльності. Представлено аналіз взаємодії процесуальної і матеріальної частин механізму банкрутства. Пропонуються основні принципи підходу до застосування санації.
The mechanisms and content of the bankruptcy procedure are the subject of the article. The article concerns legal issues and the problem of reimbursement after proclamation of bankruptcy. It comprises the review of Ukrainian national legislation and the newly adopted Civil Code as well as foreign experience and case law on the issue. Environmental issues pertaining to bankruptcy and reimbursement are also dealt with.
