В даній статті піддається аналізу сучасний стан дослідження такої важливої юридичної категорії як "правова реальність". Відповідно автором критично осмислюються здобутки та прорахунки вітчизняної науки. При цьому робиться висновок, що це поняття слід розглядати в світлі розвитку філософсько-теоретичної думки з позиції правових онтології та гносеології.
В данной статье подвергается анализу современное состояние исследования такой важной юридической категории как "правовая реальность". Автором критически осмысливаются достижения и просчеты отечественной науки. При этом делается вывод, что это понятие следует рассматривать в свете развития философско-теоретической мысли с позиции правовых онтологии и гносеологии.
In this article the current state of research such legal category as "legal reality" is exposed to the analysis. Achievements and miscalculations of domestic science are critically comprehended. In this article the current state of research such all – but to legal category as "legal reality" is exposed to the analysis. According to the author achievements and miscalculations of domestic science are critically comprehended. Thus the conclusion becomes that this concept should be considered in the light of development of philosophical and theoretical thought from a position legal ontology and gnoseology. In our country the philosophy of law is no longer in its infancy state, it is the seed sprouted, and the idea failed to take root and see their obvious-tion potential. However, this science has not stood firmly on our feet, water-in hard punches its way up the hill, and so has not yet taken a worthy place in the theoretical law, as happened in the West, where it has a strong tradition and glorious history of its development. So rather we trudge in the wake of world-government idea comprehension ius. Already it is time to correct the situation. At present, we can conclude with certainty (and with this accomplished and indisputable fact, probably no one would argue) that the Ukrainian state forever gone in the past as a Marxist understanding of the law (as an instrument of class rule) and its post-Soviet palimpsest. In turn, removal, followed by rejection at the end of the last century, the country's monopoly on truth in science has generated a corresponding plurality of vision concept ius. Against this background, there is the presence of numerous concepts thinking that mutuallyexclusive. And sometimes it seems the presence of the effect of "Tower of Babel, which collapsed": participants general legal dispute often can not hear each other.
