У статті виявлено сутнісні ознаки та сформульовано дефініцію функцій юридичної відповідальності у приватному праві. З цією метою було здійснено аналіз наукових позицій щодо розуміння сутності функцій юридичної відповідальності та розкрито структуру функцій юридичної відповідальності у приватному праві. Запропоновано функції юридичної відповідальності в приватному праві розглядати як напрями правового впливу відокремленої системи юридичних норм на однорідні, індивідуальні суспільні відносини приватного характеру, що проявляються у встановленні певних правових меж поведінки особи з метою реалізації права
В статье выявлены сущностные признаки и сформулированы дефиницию функций юридической ответственности в частном праве. С этой целью был осуществлен анализ научных позиций понимания сущности функций юридической ответственности и раскрыта структура функций юридической ответственности в частном праве. Предложены функции юридической ответственности в частном праве рассматривать как направления правового воздействия обособленной системы юридических норм на однородные, индивидуальные общественные отношения частного характера, которые проявляются в установлении определенных правовых границ поведения лица с целью реализации права.
The article reveals the essential features and functions are formulated definition of legal responsibility in private law. To this end, research was conducted scientific understanding of the functions of the positions of legal responsibility and disclosed the structure of the legal liability in private law. Given the diversity of views on the structure functions of legal liability, we supported the opinion on the need for the allocation of the structure function of regulatory legal responsibility; punitive; educational; renewing; incentive functions. Similarly, but with a specific private law sphere of legal regulation, the structure functions of legal responsibility in private law, consists of regulatory, educational, repairing, incentive and punitive functions. The results of the analysis determined that the regulatory function legal responsibility is in the private sphere of legal action on private relations in order to ensure proper functioning of the legal regulation; restoring - one of the main legal impact on affected private relationship for the purpose of recovery and regulation; educational - the influence of legal responsibility in private law through the implementation of measures to form lawful conduct of persons who have committed offenses in the field of private law and persons who previously had not committed offenses; incentive - direction of influence on the minds and behaviour of individuals through the formation of a positive attitude to the current law through approval or encouragement from authorized entities of private law relationships; punitive - direction of the impact of legal responsibility in private law subjects for offenses committed in private law and is the condemnation of the offender's conduct and the deprivation of personal and / or material nature. Based on the structure of the considered functions of legal responsibility in private law proposes to understand the past as separate areas of legal enforcement system of legal rules on uniform, individual social relations of a private nature, manifested in the establishment of certain legal limits of individual behaviour in order to implement the law.
