The paper analyzes the features of upbringing children in civil law, in particular under the Civil Code of Georgia. The author examines the concept of the family as a social phenomenon and its underlying principles. The right of parents to participate in the upbringing children is an "absolute" right and nobody can prevent its realization. Therefore, the law protected this right from violation. The issue of upbringing children is based on the agreement of parents. One of the parents can not solve the issues related to the education of the child alone. Both parents have equal rights with respect to their children, even if they are divorced. After the dissolution of the marriage, the relationship of parents with children is characterized by certain features that are often determined by a separate living of father and mother. The agreement on the place of residence and parenting after divorce is intended to achieve the optimum mode for the life of the child.
