This paper examines the views of scholars on the definition of "medical error" and its causes, and studied the twin concepts of medical error: medical and legal. A central place in the legal status of the individual in Ukraine belongs to the naturaland inalienable right of every person to health. Human health is one of the main social values and preferences of the modern civilized society. It is the largest public and private benefit and wealth, the basis of national security. But all these important rights of human and citizen may be violated as a result of a physician's error during providing medical care. A person applying for medical assistance (services) relies on its proper quality and efficiency. Sometimes, however, this person receives medical services of poor quality, or not fully, so that causes harm for his health or life. Also provided service may contain a defect for various reasons. In Ukraine the problem of medical errors is the "popular" subject of research by doctors and lawyers, however the term "medical error" doesn't have legitimate legal provisions.
