В статті йдеться про правове становище туриста за чинним законодавством як споживача. Звертається увага на його права у публічній та приватній сферах, обґрунтовується парадигма переважаючих прав туриста за умови обмеження зловживання ними загальними обов'язками дотримання національного режиму і соціальних цінностей. Вказується що при вирішенні спорів з порушенням прав туриста слід виходити із положень актів чинного законодавства
В статье говорится о правовом положении туриста по действующему законодательству как потребителя. Обращается внимание на его права в публичной и частной сферах, обоснована парадигма преобладающих прав туриста при условии ограничения злоупотребления ими общими обязанностями соблюдения национального режима и социальных ценностей. Указывается что при разрешении споров с нарушением прав туриста следует исходить из положений актов действующего законодательства
The article refers to the legal status of a tourist under current law as a consumer. Attention is drawn to his rights in the public and private sectors is justified by the prevailing paradigm of human tourists constraints abuse compliance with general obligations of national treatment and values. Purpose of this article is studying paradigm of the legal status of human as a consumer in the contract for provision of tourist services that can be applied to the other consumer contracts. The object of the article is a legal status of a tourist as a party of the legal relation, and the subject – is acts of the current international and national legislation, practice of its implementation and provisions of scientific doctrine. The legal status of the contracting parties is a key element of the legal regulation of such relations. Article 20 of the Law of Ukraine "On Tourism" determines parties of the agreement on the provision of tourist services as the travel agent, tour operator, on the one hand, and tourists – on the other. Since the agreement on the provision of tourist services refers to the consumer agreements, in the foreground of such contracts must be ensuring tourists' rights and this should be reflected in its definition.
