Звернуто увагу на недоліки актів чинного законодавства і запропоновано ті з них, які суперечать Конституції України, ЦК та ГК України, відмінити. Акцентовано на елементах правового регулювання цих правовідносин, які моделюються нормами права та на співвідношенні договірного і законного регулювання
В статье речь идет о правовом механизме регулирования отношений по перевозке как направления правового воздействия норм права на юридически значимое поведение их участников. Обращено внимание на недостатки актов действующего законодательства и предложено те из них, которые противоречат Конституции Украины, ГК и ХК Украины, отменить. Акцентировано на элементах правового регулирования этих правоотношений, моделируются нормами права и на соотношении договорного и законного регулирования
The article refers to the legal mechanism for regulating relations with transportation as areas of legal enforcement of the law in a legally meaningful behavior of the participants. Pay attention not shortcomings of current legislation and regulations proposed to those that are contrary to the Constitution of Ukraine and the Central Committee of the Civil Code of Ukraine abolished. Regulation of transportation and its varieties is provided through an influence of the law and legal rules on the participants of these regulations. With regard to different aspects and areas of its influence in the regulation of transportation we can separate different positions: a) general theoretical; b) industrial or sub-sectoral; c) institutional.
