В статті йдеться про цивільно-правову відповідальність адвокатів у разі порушення зобов'язань за договором з надання правової допомоги. Автор виходить із того, що положення спеціального закону про неможливість притягнення адвоката до відповідальності не повинне поширюватися на зазначений договір: імунітет від договірної відповідальності неприпустимий, погіршує правове становища клієнтів, провокує адвокатів на порушення зобов'язань. Відстоюється необхідність закріплення такої відповідальності у законі.
В статье речь идет о гражданско-правовой ответственности адвокатов в случае нарушения ими обязательств по договору на оказание правовой помощи. Автор исходит из того, что положения специального закона о невозможности привлечения адвоката к ответственности не должно распространяться на указанный договор: иммунитет от договорной ответственности недопустим, ухудшает правовое положения клиентов, провоцирует адвокатов на нарушение обязательств. Отстаивается необходимость закрепления такой ответственности в законе.
