This article discusses the use of the polygraph and received with the help of data proving, as one of the possible evidence in criminal proceedings. Todosiienko Admissibility of use in proving the actual data that has been obtained using the polygraph The use of polygraph and results in criminal proceedings is recognized as a legal fact and increasingly finds support among local scientists and practitioners study the issue. However, no legal provision for the regulation of activities associated with the use of the polygraph, raises a number of issues of a legal nature, in particular for use in proving the admissibility of evidence that have been produced by this science and technology unit. Аnalysis of individual items preliminary investigation of registered criminal offenses, which were held under the control of physiological polygraph examination showed thatobtained with this instrument the results are not always found reflection in the proceedings concerning the admissibility of their use in proving as evidence in conjunction with other materials collected by investigators. We believe that this issue needs assessment and reconsideration of submission of specific proposals aimed at overcoming gaps in the Criminal Procedure with respect to the results of a polygraph expert studies and their place in the system of providing evidence. To achieve thisgoal the following objectives: - Specific examples to demonstrate the place of expert polygraph examination evidence provided in other countries; - To consider the scientific position of foreign and domestic scientists about the place of the data performed by expert polygraph examination system of evidence; - Offer and justify their own vision Place of psychophysiological expert checks in criminal proceedings.
