Стаття присвячена дослідженню особливостей порушення справ про перевезення пасажирів через державний кордон України без належних документів під час здійснення міжнародних пасажирських перевезень, визначено особливості цієї стадії, коло осіб, що мають право їх порушувати, а також запропоновано конкретні пропозиції по удосконаленню чинного законодавства.
Статья посвящена исследованию особенностей возбуждения дел о перевозке пассажиров через государственную границу Украины без надлежащих документов при осуществлении международных пассажирских перевозок, определены особенности этой стадии, круг лиц, имеющих право их возбуждать, а также предложены конкретные предложения по совершенствованию действующего законодательства.
This article researches the features of initiation of the cases about passenger transportation across the state border of Ukraine without proper documentation on international passenger traffic, the peculiarities of this stage, and the scope of persons entitled to initiate them. Vasylyk The features of initiation of the cases about passenger transportation across the state border of Ukraine without proper documentation on international passenger traffic The article investigates features of initiation of passengers across the state border of Ukraine without proper documentation on international passenger traffic, the peculiarities of this stage, the circle of persons entitled to violate them, and offeres specific suggestions to improve the current legislation. In theory of administrative law and procedure of the cases of administrative offenses it is divided into four stages: the institutionof proceedings; review and resolution of the case; appeal and protest resolution of the case; execution of the order. The author proved that the same stage inherent in the proceedings of passengers across the state border of Ukraine without proper documentation on international passenger traffic. The author notes that limiting the categories of persons entitled to institute such proceedings is impractical because of significant shifts in leadership structure of border protection, which may result in the delay of the opening of proceedings. The article emphasized that reports on administrative offenses for passengers across the state border of Ukraine without proper documentation on international passenger services should be in all cases identify administrative offenses, regardless of whether the facts of guilty carrier. The failure of the person who controls the vehicle or carrier representative to sign the report there is a record of it. A person driving the vehicle or agent of the carrier has the right to give explanations and comments on the content of the protocol annexed to the report and explain the reasons of refusal to sign. In conclusion the author says that the inadequacy of national legislation in the field of study requires additional processing and synthesis.
