У статті аналізуються погляди відомого українського громадського і культурного діяча, адвоката, письменника О. Я. Кониського (1836-1900) на проблеми, пов'язані з процедурою визначення форми і ціни позову та розміру винагороди за судові витрати та його забезпечення судовим розглядом в другій половині ХІХ ст. і шляхи їх розв'язання; показано їх актуальність для сучасної юридичної науки.
В статье анализируются взгляды известного украинского общественного и культурного деятеля, адвоката, писателя А. Я. Конисского (1836-1900) на проблемы, связанные с процедурой определения формы и цены искаи размер суммы вознаграждения за судебные издержки и его обеспечение судебным рассмотрением во второй половине ХІХ ст. и пути его решения; указано на их актуальность для современной юридической науки.
This article analyzes the views of the famous Ukrainian social and cultural activist, lawyer, writer A.J. Konyskyi (1836-1900) on issues related to the procedure for determining the form and price of the claim and compensation for court costs and providing it by trial it in the second half of the nineteenth century, and their solutions. Konysskyi on determination of the form and price of claim and amount of remuneration for court costs and its trial support An important means of civil procedure which ensured the implementation of the right of access to court is an action that is specified in the legal literature as requiring a person to defend his or someone else's rights or legally protected interest [9, p. 28]. The suit consists of three parts: a subject basis and content that are together in close contact. Notable among claims takes action to determine the shape and size of price action and compensation for legal fees. In the late nineteenth century. many aspects concerning the trial of such claims have been contradictory and unclear. Therefore, an important scientific and theoretical and practical significance have now a study of the problems of law, that were developed by then outstanding lawyers, a special place among them belongs to the writer, social and political activist, a lawyer by profession, Oleksandr Konys'ky? (1836-1900); legal opinions, despitea considerable number of studies (A. Dyachenko, A. Mysyura, L. Ozhohan, M. Syvachenko, Skorobohatko N. et al.) has not yet been the subject of study. Therefore, the purpose of this article is to analyze the views of O. Konysky using his publications for the determining of the shape and size of the claim compensation for legal costs and ensure its trial in the second half of the nineteenth century; to show their relevance for modern jurisprudence.
