У статті досліджуються питання співвідношення групового позову та інших видів представницьких позовів. Зроблено висновок, що груповий позов, похідний позов, позов на захист невизначеного кола осіб є самостійними видами представницьких позовів. Встановлений критерій для їх розмежування, яким є спрямованість інтересу, що підлягає захисту при застосуванні певного виду цих позовів.
В статье исследуются вопросы соотношения группового иска и других видов представительских исков. Автор делает вывод, что групповой иск, производный иск, иск в интересах неопределенного круга являются самостоятельными видами представительских исков. Установлен критерий для их разграничений, в качестве которого выступает направленность подлежащего защите интереса при обращении с определенным видом иска.
The questions of correlation of group action and other types of representative actions are probed in the article. In science of civil procedure there are a few scientific doctrines to the decision of correlation of such concepts as a "group action", "derivative action", "action, on defence of rights and interests of indefinite persons". The author gives a conclusion, that all these actions are separate types of representative actions. Group action is directed on defense of private interests, action in interests of indefinite persons, – on defence of public interest, derivative action, – privately public. Differences in the orientation of character of interest, which is subject defence, stipulate independence each of these types of action. A "class action" (term of the American law) and "group action" are identical concepts. Legal essence of collective action is not enough investigated. Term a "collective action" is used in the legislation of the European Union, but it does not contain a clear decision, that is why it needs subsequent scientific research.
