У статті автором встановлено особливості комерційного посередництва як окремого інституту господарського права, визначено його ознаки, принципи, склад відносин та обов'язки суб'єктів. На підставі проведеного дослідження встановлено, що комерційне посередництво – це нова для України економіко-правова категорія, що потребує належного правового регулювання та інституційного розвитку.
В статье автором установлены особенности коммерческого посредничества как отдельного института хозяйственного права, определены его признаки, принципы, состав отношений и обязанности субъектов. На основании проведенного исследования установлено, что коммерческое посредничество - это новая для Украины экономико-правовая категория, требует надлежащего правового регулирования и институционального развития.
In the article the author of the specific features of commercial mediation as a distinct institution of commercial law, defined its characteristics, principles, composition and duties of the subjects of relations. The author has analyzed the modern scientific doctrine and legal provisions that regulate social relations in the field of mediation. The author researched the definition of the category, which, in view of the author, is the kind of economic activity that is carried out only by business entities, the essence of which is to provide information and advisory and representation services as well as facilitating the creation of new obligations for the benefit by clients. The purpose of this article is to reason an independent role of mediation as one of the important components of market economy, making theoretical and practical recommendations concerning improvement of economic legislature in this sphere. Based on the research it was found that commercial mediation is a new for Ukraine economic and legal category that requires proper legal regulation and institutional development.
