В статті йдеться про необхідність подолання різнобіжностей в класифікації інвестиційних договорів. Автор розробив підхід щодо їх характеристики на основі галузевого пристосування давно відомих цивільних договорів до потреб обслуговування інвестиційних процесів. Застерігається проти механічного перенесення категорій цивільно-правового та господарсько-правового договорів на інвестиційні договори, що є безперспективним.
В статье идет речь о необходимости преодоления разбежностей в классификации инвестиционных договоров. Автор разработал подход относительно их характеристики на основе отраслевого приспособления давно известных гражданских договоров к потребностям обслуживания инвестиционных процессов. Предостерегается против механического перенесения категорий гражданско-правового и хозяйственно-правового договоров на инвестиционные договоры, которые являются бесперспективными.
The article deals with the necessity of overcoming the differences in classification of investment contracts. The author worked out the approach concerning their characteristic on the basis of branch adaptation of old-established civil contracts to the needs of maintenance of investment processes. The categories of civil and commercial contracts are warned against being mechanically transformed into investment contracts; that lacks of any prospect. English abstract R. Shyshka Investment agreements: characteristic and classification attempts The article deals with the necessity of overcoming the differences in classification of investment contracts. The author worked out the approach concerning their characteristic on the basis of branch adaptation of old-established civil contracts to the needs of maintenance of investment processes. The categories of civil and commercial contracts are warned against being mechanically transformed into investment contracts; that lacks of any prospect.The author pays attention to the primary position and states that according to it an investment contract is an agreement between two or more sides that aims at setting, changing or termination of investment subjective rights or obligations, but in the sphere of the investment law that is coordinated with the Art. 626 of Civil Code of Ukraine and supported among most scientists of contract law field. All the classifications of investment agreements given in the article gave in common the following aspects: 1) they are ordinary civil contracts; 2) their purpose is to be able to regulate relations towards special object – investments; 3) some of these classifications are partly artificial and archaic; 4) in practical meaning this word “investment” in the name of this kind of contract doesn't really make any change or solve any problem. The author also mentions that successful classification of investment contract may be done in the case of abstraction from the agreement characteristic andunderlining its branch adoption.
