Стаття присвячена новим змінам, внесеним у 2013 році до Кримінального кодексу України щодо кримінальної відповідальності юридичних осіб. Аналізуються доктринальні положення кримінального права України. Розглядається питання про невідповідність міжнародних стандартів в галузі кримінального права і традиційних підходів до основних інститутів кримінального права України.

The article is devoted to the new amendments made in 2013 to the Criminal Code of Ukraine concerning the criminal liability of legal persons. Analyzes the doctrinal provisions of the criminal law of Ukraine. The question of non-compliance of international standards in the field of criminal law and traditional approaches to the major institutions of the criminal law of Ukraine. English abstract S. Lykhova Legal persons as subjects of criminal liability for the Criminal Code of Ukraine The articleis devoted to the new amendments made in 2013 to the Criminal Code of Ukraine concerning the criminal liability of legal persons. The doctrinal provisions of the criminal law of Ukraine are analyzed. The questions of non-compliance of international standards in the field of criminal law and traditional approaches to the major institutions of the criminal law of Ukraine are considered. It's underlined in the article that legal persons can be the subjects, in general, of corruption and terrorismcrimes. The author also points out that lots of articles compete with each other. The mechanism of criminal liability doesn't practically act towards people's deputies of Ukraine, President and others higher officials of the state, as it doesn't correspond with the Constitution of Ukraine and the order of bringing a charge against them is more complicated. Installation of the criminal responsibility of legal persons' institution influences the understanding of the content of other legal institutes. As a conclusion the author states that the changes that are being made nowadays to the Criminal Code of Ukraine are based not on the scientific approaches and are a little chaotic and antisystematic, what is resulted in ruining of the general theoretical constructions of the criminal law science. The gap between legislature and science is being getting worse, and this doesn't help to form a stabile politics in the sphere of struggling criminality.
